1. Object

1.1 Under the terms and conditions below, the Contracting Party shall provide the Services to the Contracting Party with the services provided for in the use of the EVENTSMTB platform.

1.2 The System will be made available to the Contractor through remote access to the Contractor’s server, in compliance with all the terms and conditions established in the General Terms and Conditions of Use of the platform.

1.3 The Contractor acknowledges and accepts that the contracted services are exactly those provided for in these general conditions, and the Contractor is not obliged to provide any functionality, improvement or feature incorporated into the System.

1.4 In the event of a new version, functionality, improvement or feature incorporated into the System, the Contractor will update the services, however, it is solely up to the Contractor to decide to update and add new services to the contracted plan.

1.5 EVENTSMTB’s responsibility is limited to ensuring access to the platform for the dissemination of events, and registration for tests and/or events.

1.6 This excludes any liability for failure to hold the events/events, for failure to comply with legal issues regarding the organization and holding of events/events, for the payment of monetary amounts agreed between the party that intends to participate in the event and the entity event promoter.

1.7 The Contractor will not be responsible for any errors or delays in the content, or for any actions taken based thereon, nor in case there is a need to update or carry out repairs on the platform or in the event of any problem at the server level.

2. Service

2.1 The Contractor is a platform that provides, free of charge, the dissemination of events/events.

2.2 The responsibility for the organization of the events, the fulfillment/observance of all legal issues associated with them are the exclusive responsibility of the promoters of the events and/or events.

2.3 All information from the tests launched are subject to validation by the Contractor’s team, in order to ensure the proper use of the content to which it relates and the purpose for which the platform was developed.

3. Responsibilities for the Inserted Content

3.1 The proposal consists of the provision of web services by the Contractor to the Contracting Party. However, the entire content of the information is the responsibility of the Contracting Party, which is solely responsible for all texts, images and videos, including copyright and other legal implications in their disclosure and use.

3.2 The Contractor may not, in any way, copy, reproduce, translate, adapt, modify, dispose of, sell, lease, sublease, assign, transfer or reverse engineer the System, in whole or in part, or use the System for any purpose other than that which you were specifically authorized to do, nor allow any third party to do so.

4. Registration of event registrations:

4.1 To facilitate the management of registration of registrations in events or events, the platform makes the use of this service available to all event promoters.

4.2 This service has a value of sixty-five cents per registration plus VAT at the legal rate in force, whenever legally applied.

4.3 The Payment Gateways available for enrollment are:

– Mbway;
– Paypal;
– Credit Card;
– ATM reference.

4.4 Each of these Payment Gateways charge transfer fees, which will be the responsibility of the promoter, and therefore, EVENTSMTB is already entitled to pay the fees and respective VAT, deducting them from the registration fee to be transferred, as well as the value of using the service (sixty-five cents plus VAT for each registration).

4.5 The Contractor uses services from third parties, such as Payment Gateways, as such cannot guarantee the non-variation of the fees of its services as well as unconditional access and full operationalization of the service, these costs always being attributable to the promoter. of the event.

4.6 The Contractor will make available the value of the registrations, deducted from the amounts identified above each week, upon delivery of an invoice.

5. General Provisions

5.1 By accessing the platform, you agree to comply with the Terms and Conditions and legal information relating to this platform and any material contained therein, which you acknowledge having read and understood.

5.2 If you do not agree with these Terms and Conditions, you must not access this platform.

5.3 The Contractor reserves the right, in its sole discretion, to change, modify these Terms and Conditions at any time without prior notice.

5.4 Your continued use of this platform after any changes constitutes your acceptance.

5.5 The use of this register for users who register for the events/events does not exempt them from reading the conditions of the event or race with their promoters.

6. Intellectual Property

6.3 Any unauthorized reproduction for commercial purposes of the information on the platform is a violation of the Contractor’s rights.

6.4 The use of intellectual property rights that appear or are in any way linked to the provision of services contracted herein shall be used restricted to the object of this Agreement and the respective Proposal(s), in accordance with the established conditions, and shall the parties preserve such rights of the counterparty, whether related to their trademarks, copyrights, computer programs, as well as other intellectual property rights mentioned herein and related to the System.

6.5 The Contracting Party must take all security measures so that its personnel and/or third parties do not violate any of the Contractor’s intellectual property rights, and must immediately notify the Contractor in the event of any intellectual property violation of which it becomes aware. .
